1. Do employers need to conduct domestic recruitment before hiring overseas graduates for hospitality work?
Yes. Employers must first recruit locally under reasonable working conditions. If local recruitment cannot meet hiring needs, employers may apply to the Ministry of Labor for a work permit to hire overseas graduates.
2. Does each overseas graduate require a separate recruitment process?
No. If hiring multiple overseas graduates, employers may apply for domestic recruitment in one application. The public employment agency will issue one recruitment certificate and list different serial numbers based on the shortage count.
3. What are the rules for continued employment?
Employers must apply to the Ministry of Labor for a continued employment permit within 15 days after receiving the continued employment certificate.
4. Is proof of skill requirements needed when extending the employment permit?
No. Employers do not need to submit proof of skill requirements for permit extension.
However, if the overseas graduate changes employers, proof of skill requirements is required again unless the salary meets the exemption standard.
5. Is there a hiring quota for hospitality service work?
Yes. The total number of overseas graduates hired must not exceed 30% of the employer’s average number of employees in the past year.
However, employers may hire at least one person.
1. What training courses are accepted for hospitality service work?
The overseas graduate must complete at least 80 hours of one of the following courses and obtain proof or a signed statement:
1. Courses held by the Tourism Administration or recognized industry associations.
2. Internship courses offered by colleges or universities recognized by the Ministry of Education.
3. Tourism or hospitality training courses provided by the employer.
2. Are overseas graduates who have already left Taiwan eligible?
Yes. Foreign students, overseas Chinese students, or other ethnic Chinese students who graduated from a college or university in Taiwan with an associate degree or above are eligible, whether they are still in Taiwan or have already left.
3. What is the reasonable salary for domestic recruitment?
The reasonable salary standard for recruiting local workers for hospitality service work is NT$33,000 per month.
4. What are the salary requirements for hospitality service work?
For regular employment, the monthly salary must be at least NT$33,000, or the annual salary must be at least NT$500,000.
For first-time employment, the monthly salary must be at least NT$30,000.
If the monthly salary reaches NT$35,000 or more, the training course requirement may be waived.
5. After the first 3-year employment period ends, does the salary return to NT$33,000?
Yes. For first-time employment, the monthly salary must be at least NT$30,000.
For non-first-time employment, the salary offered by the original or new employer must be at least NT$33,000.
1. Is there a limit on the employment period or total working years?
There is no total working-year limit for overseas graduates working in Taiwan.
Each employment permit is valid for up to 3 years. Employers may apply again if they remain eligible.
2. Can overseas graduates change employers?
Yes, but only with approval and for reasons not attributable to the overseas graduate.
The transfer process follows the same rules as blue-collar migrant workers.
3. How can employers continue hiring after the permit expires?
Employers who wish to continue hiring must apply for a permit extension within 4 months before the current permit expires.
4. Can approved overseas graduates register for employer transfer at a public employment agency?
Yes. If employer or job transfer is approved, the original employer or the overseas graduate may submit the required documents to a public employment agency for transfer registration.
5. Do overseas graduates need a health check?
1. For overseas graduates entering Taiwan from abroad, a health check must be completed within 3 working days after entry. Regular health checks are also required around the 6th, 18th, and 30th month after the permit becomes effective.
2. For overseas graduates already in Taiwan, employers may submit a valid Category 2 or Category 3 health check certificate issued within the past 3 months. Regular health checks are also required around the 6th, 18th, and 30th month.
