When is a work permit not required?
A work permit is not required in the following cases:
1. Foreign nationals hired by government agencies or affiliated academic/research institutions as consultants or researchers.
2. Foreign nationals married to ROC nationals with household registration in Taiwan and approved for residency.
3. Foreign nationals hired by public or registered private universities for lectures or academic research approved by the Ministry of Education.
4. ROC nationals without household registration in Taiwan.
5. Mainland Chinese spouses approved for dependent residency, or Mainland Chinese residents approved for special long-term residency.
Is there a required format for the employment contract?
No specific format is required. However, the contract should include the foreign employee’s name, nationality, job title, duties, salary, employment period, and signatures from both parties.
How can I apply for a replacement if my work permit letter is lost? Is there a fee?
The employer or foreign worker may apply for a replacement by submitting an application form and selecting “Other,” with “Replacement” noted.
A statement explaining the reason for replacement is required, including the original permit number, the foreign worker’s name, passport number, employment period, and reason for replacement.
The review fee is NT$100.
Do dual nationals need a work permit?
Yes. ROC nationals who also hold foreign nationality but do not have household registration in Taiwan are treated as foreign nationals and must apply for a work permit.
How long does it take to process a foreign professional work permit?
Online application:
If all documents are complete and both the employer and foreign worker meet the requirements, processing takes 7 working days from the day after the application is received.(https://ezwp.wda.gov.tw/)
Paper application:
Paper applications are only allowed under special circumstances, such as natural disasters or system outages.
If all documents are complete and requirements are met, processing takes 12 working days from the day after the application is received.
Can Hong Kong or Macao residents apply for an employment permit?
Yes, eligible Hong Kong or Macao residents may apply under regulations for foreign nationals.
Hong Kong or Macao residents with overseas Chinese status, or spouses and children who meet ROC nationality requirements, may apply under the regulations for Hong Kong and Macao residents with overseas Chinese status.
Those who do not meet the above qualifications are treated as Mainland Area residents. Mainland Area residents are currently not permitted to work in Taiwan.
